These Terms and Conditions (“Terms”) govern your access to and use of www.native.style (the “Site”) and your purchase of products from Native Style, a DBA of Litefoot Enterprises, LLC, a Montana limited liability company registered to do business in the State of Texas (“Company,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to make a purchase on the Site. By placing an order, you represent that you meet this requirement and that all information you provide is accurate and complete.
2. Products and Pricing
All product descriptions, images, and prices are subject to change at any time without notice. We make reasonable efforts to display products accurately, but we do not warrant that colors, dimensions, or other details will be exact, as display may vary by device. All prices are listed in U.S. dollars unless otherwise stated. We reserve the right to correct pricing errors, and if a product is listed at an incorrect price due to error, we may cancel any orders placed at the incorrect price, even after order confirmation, and will issue a full refund for any amounts charged.
3. Orders and Payment
Your order constitutes an offer to purchase, which we may accept or decline at our sole discretion. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, product unavailability, or errors in product or pricing information. Payment is due in full at the time of order and is processed securely through our third-party payment processors via WooCommerce. By submitting payment information, you represent that you are authorized to use the payment method provided. Questions about orders should be directed to orders@native.style.
4. Shipping and Delivery
We ship to the addresses provided at checkout. Shipping timeframes are estimates only and are not guaranteed. Risk of loss and title for products pass to you upon our delivery of the products to the shipping carrier. We are not responsible for delays, loss, or damage caused by shipping carriers, incorrect addresses provided by the customer, or circumstances beyond our reasonable control. If your order arrives damaged, contact orders@native.style promptly so we can assist you.
5. Returns, Exchanges, and Refunds
All sales are final. We do not accept returns or provide refunds or exchanges except under the following conditions: (a) the product you received is defective or damaged upon arrival; (b) you received an incorrect item due to our error; or (c) a refund is otherwise required by applicable law. To request a refund or exchange under these conditions, contact orders@native.style within 7 days of delivery with your order number and, where applicable, photographs of the defective, damaged, or incorrect item. Approved refunds are issued to the original payment method within a reasonable period after review. We reserve the right to deny any request that does not meet the conditions above.
6. Intellectual Property
The Native Style name and trademark are owned by Litefoot Enterprises, LLC. All content on the Site — including text, graphics, logos, designs, images, photographs, and software — is the property of Litefoot Enterprises, LLC or its licensors and is protected by United States and international trademark, copyright, and other intellectual property laws. You may not use, reproduce, distribute, modify, or create derivative works from any Site content, including the Native Style name and marks, without our prior written consent. Nothing in these Terms grants you any license or right to use any trademark, logo, or other proprietary material of Litefoot Enterprises, LLC.
7. User Conduct
You agree not to use the Site for any unlawful purpose; to interfere with or disrupt the Site, servers, or networks; to attempt to gain unauthorized access to any portion of the Site or any systems connected to it; to use any robot, scraper, or other automated means to access the Site without our permission; or to submit false or misleading information. We reserve the right to terminate or restrict your access to the Site for violation of these Terms.
8. User Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at admin@native.style of any unauthorized use of your account.
9. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR AS REQUIRED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LITEFOOT ENTERPRISES, LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Litefoot Enterprises, LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Litefoot Enterprises, LLC is a Montana limited liability company registered to do business in Texas, with its principal place of business in Frisco, Texas. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement; Changes
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Litefoot Enterprises, LLC regarding the Site. We may modify these Terms at any time by posting revised Terms on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
